1. Who we are
Manifest Chess is operated by MB Ordinary Ventures, a small partnership registered in the Republic of Lithuania under company number 307541958, with its registered office at Eduardo Andrė g. 14-5, LT-02232 Vilnius, Lithuania ("we", "us", "our").
"Manifest", "Manifest Chess", "the App" and "the Service" each refer to the Manifest Chess desktop application and the manifestchess.com website. You can reach us at hello@manifestchess.com.
2. Acceptance of these terms
Please read these terms carefully before downloading or using the App. By installing Manifest, creating an account, starting a free trial, or purchasing a subscription, you agree to be bound by these terms. If you do not agree, please do not install, use, or pay for the App.
3. The licence we give you
We grant you a personal, non-exclusive, non-transferable licence to install and use Manifest on devices you own or control, for your own non-commercial chess study, for as long as your access remains active. The licence also covers updates, supporting materials, and related online services that we provide through the App.
You may not sublicense, resell, distribute, or share your access with anyone else.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in a way that infringes anyone's rights.
- Attempt to gain unauthorised access to the App, the website, or any related systems.
- Use automated tools to scrape, mirror, or extract data from the App or the website beyond what the App itself offers.
- Reverse engineer, decompile, or attempt to derive the source code of the App, except to the extent expressly permitted by applicable law.
- Resell, redistribute, or commercially exploit the App or its content.
- Harass, abuse, or harm another person through any feature we provide.
5. Subscriptions, trial, and payment
Manifest is offered on a single plan with two billing options: €9.99 per month, or €49.99 per year. New users can start a 14-day free trial on either option. Payment details are collected at signup so the subscription can begin automatically when the trial ends. You can cancel any time during the trial, and you will not be charged.
Subscriptions are billed in euros (EUR) through our third-party payment provider and renew automatically, on the monthly or annual anniversary of your first charge, unless you cancel before the renewal date.
You can cancel your subscription at any time. Cancellation takes effect at the end of your current paid period.
6. Refunds
If you change your mind after subscribing, you can request a refund within 14 days of the charge. Refund requests are reviewed in line with our Complaints Policy, which sets out the information we need and how we respond.
7. Your data and our Privacy Policy
We take your privacy seriously. Details of what personal data we collect, how we use it, and your rights are set out in our Privacy Policy. Please read it before using the Service.
8. Third-party services and links
Manifest can connect to external chess platforms such as Lichess and Chess.com at your request. When you choose to connect or pull data from these platforms, your use of them remains subject to their own terms and privacy policies.
The App and the website may also contain links to third-party websites or content that we do not control. Following such links is at your own risk. Including a link is not an endorsement, and views expressed on third-party sites are not our own.
9. Intellectual property
All content, features, and functionality of the App and the website, including the software, designs, text, graphics, logos, and the "Manifest" name and marks, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these terms transfers any of these rights to you. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.
Chess games and positions you import or create remain yours.
10. Changes to the App, website, or these terms
We may update, improve, or change features of the App and the website at any time. We may also update these terms from time to time. When we do, we will post the updated version on this page and revise the "last updated" date above. Continuing to use Manifest after a change means you accept the updated terms.
11. Disclaimers
The App and the website are provided on an "as is" and "as available" basis. We do not give any warranties or make any representations, either express or implied, in relation to:
- The functionality, availability, or accuracy of the App or the website.
- The completeness or correctness of any information shown, including chess data imported from third-party platforms.
- The website or App being free from defects, errors, bugs, or viruses.
Any information shown is provided for informational purposes only and should not be relied on as advice. We cannot guarantee that the App or the website will always be available or uninterrupted.
12. Limitation of liability
To the maximum extent permitted by law, we shall have no liability for indirect, incidental, special, or consequential losses arising out of or in connection with your use of the App or the website, including loss of data, loss of profits, or business interruption.
Nothing in these terms limits any liability that cannot be limited under applicable law, including your statutory rights as a consumer.
13. Termination
You can stop using Manifest and cancel your subscription at any time. We may suspend or end your access if you materially breach these terms. Where appropriate, we will give you notice and a chance to fix the issue first.
When your access ends, the sections that by their nature should survive, including the licence limits, intellectual property, disclaimers, and liability provisions, continue to apply.
14. Governing law and jurisdiction
These terms, and any dispute or claim arising out of them or their subject matter, are governed by the laws of the Republic of Lithuania. The courts of Lithuania have exclusive jurisdiction to settle any such dispute, except where mandatory consumer protection rules in your country of residence give you the right to bring proceedings elsewhere.
